HOLBROOK — The man accused of inappropriately touching another student at Snowflake High School back in Nov., 2017, is facing two separate trials on multiple charges that also have the possibility of sending him to prison for decades.
Joey Ferrall Fish, 18, of Snowflake, was in court Monday, April 9, for a comprehensive pre-trial hearing with Navajo County Superior Court Judge Dale P. Nielsen. Fish was there with his mother and grandfather.
He has pleaded not guilty to sexually assaulting a fellow student at the high school who is on the wrestling team as was Fish until his arrest. Fish allegedly held down the underage victim, allegedly with the help of 18-year-old fellow student Cody Callender, and tried to kiss the victim and reportedly put his hand either over the victims groin area over his clothes or tried to put his hand inside the victim’s pants.
Callander is facing one charge of unlawful imprisonment.
Nielson at first told Fish he could be looking at a maximum of 25 years in prison on two counts of sexual assault of a minor if he is found guilty by a jury. The presumptive sentence for that crime is five years and the minimum is three. Fish is also up on two counts of kidnapping, which come with presumptive sentences of one and one-half years.
Nielsen said that because Fish might have a previous felony on his record if he is convicted at trial of the sexual assault, he could receive a longer sentence. Fish and Ethan Taylor, 18, were charged by a grand jury with four counts of aggravated assault in a separate incident that occurred on Nov. 11, 2017, for toppling rocks onto victims in the vicinity of Five Mile Draw east of Arizona Highway 77. Police said Taylor and Fish allegedly either intentionally or unintentionally pushed the rocks down from a canyon wall onto four people who were all injured. Nielsen told Fish that if he is found guilty in the incident at Five Mile Draw, and if it is designated a dangerous felony crime, he could be looking at more than 46 years in prison or more.
Fish could also be given probation, if the judge so chooses, if he is found guilty for the Nov. 20 incident at the high school. If he is convicted on the Nov. 11 incident near Five Mile Draw however, probation in connection with the Nov. 20 incident would not be an option.
